Coaching Terms and Conditions

 

1.             Introduction

1.1      These are standard terms that set out the requirements of the client (you) and The Startup Co.

1.2      The learning in The Startup Co Coaching and other programs (herein referred to as ‘The Startup Co Programs’) and sessions belong to the client. The client is expected to be on time and prepared to learn and execute.

1.3      Results for the client may vary depending on such things as (but not limited to) the depth of your understanding of the training materials, your time and effort in executing the actions items, your consistency in executing the training materials, and your willingness to work.

1.4      The Startup Co reserves the right to make any changes to The Program and any of its related materials, including but not limited to the delivery model of the training materials and any face-to-face sessions.

2.          Professional Disclaimer

2.1      As a consultant at The Startup Co, we would love to inform you that the advice provided to you is guidance in nature and no results are guaranteed.

2.2      We do not solve legal problems.

2.3      By entering into The Startup Co Programs Membership you agree to release The Startup Co, its officers, employees, contractors and representatives and their respective heirs, successors and assigns for any claims which may otherwise have been arising out of or in any way related to participation in The Program and harmless from any loss or liability from actions taken or situations created as a result of the Coaching Sessions or relationship.

2.4      You understand that all action taken by you is performed voluntarily. Clients should seek independent professional advice before undertaking any physical, business or investment actions.

3.          Confidentiality

3.1      This is a very important aspect of the consulting relationship. Everything we discuss in any session is kept in the strictest of confidence. You are also required to maintain confidentiality of the information discussed in session as well as anything shared by any other participants.

3.2      The client is bound by Copyright laws. The client will not share any The Startup Co materials or intellectual property with any other individual. The client will not provide their login details to the Business Builder membership site to any individual for any reason.

4.          Cancellation Policy & Dishonour of Payments

4.1      When someone commits to The Startup Co Programs, they are responsible for ensuing that adequate funds are available for monthly payments. When someone decides to leave The Startup Co Programs, they are responsible for paying what is remaining (if on a payment plan).

If your monthly payment is dishonoured and fails to be received on the due date, a 5% charge will be added and retried 48 hours later. If that too fails, an additional 5% will be added and another attempt made 48hours later. At this point, if payment remains outstanding, access to The Startup Co Programs will be revoked until payment is made. There are no refunds and no holds. Legal action may be taken if you default on your payments.

5.          Intellectual Property

5.1      All material shared by The Startup Co and its representatives is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner.

You agree not, at any time, to do anything that would infringe the intellectual property rights in such materials.

5.2      Do not record any part of any session without prior permission.

6.          Media Disclaimer

By participating in Zoom sessions, you agree to waive any rights to media release, granting the organiser the discretion to use, reproduce, and distribute any audio, video, or photographic content captured during the session for promotional or educational purposes. If you do not wish to release this please advise prior to sessions.

7.          Responsibility for Change

Your Coach will do everything in their experience and power to ensure you are equipped with the mindset, tools, strategies and knowledge to create the changes and results you desire. The key to achieving the results, however, lies with you, the Client. Your unique responsibility lies in action; taking the action to achieve the results – because without action, nothing can happen.

The seven points below are a summary of your responsibility for change:

  1. The responsibility for change rests entirely with each of us.
  2. Your Coach will do everything possible to support you in achieving your own results and desired outcomes; your Coach cannot make any changes for you.
  3. You are responsible for the cause of all change within your life.
  4. Your Coach will work with you to identify solutions and offer suggestions, options and Coaching based on their own personal experience, training and the information you give them.
  5. All decisions and courses of action are entirely yours and you accept full responsibility for such decisions and actions.
  6. You should always carefully evaluate the consequences of various options and act accordingly including seeking professional advice prior to taking actions where appropriate.
  7. As a Client, you also recognise and agree that The Startup Co and its Coaches, employees and servants are not licensed investment advisors, licensed real estate agents, licensed financial planners, qualified or practicing accountants, qualified or practicing finance professionals, qualified or practicing health professionals or qualified or practicing legal professionals.
